The problem with that perspective is that the Supreme Court right now is still primarily justices placed there by Reagan. Meaning Conservative Justices.

So Ashcroft isn't pissing off the Justice System. If he keeps at it, the High Court is likely to be more sympathetic to his case than many of the lower courts.

Well, Ashcroft has managed to step on the toes of many circuit court judges already. He might not have angered and Supreme Court justices, but everything has it's effect.

The question is, then, how many of the circuit court judges are from the Clinton Years?

They have (IIRC) a significantly higher turnover than the Supreme Court.

I'm honestly not sure. They tend to represent the areas they preside over fairly closely, though, and well they should.
