As long as Oregon wins, this is a good thing. The further it gets pushed up the ladder, the better for everyone (as long as it doesn't get overturned). The more Ashcroft pisses of the variouse justices, the better, and the more precedents he gets set against him he better.
The problem with that perspective is that the Supreme Court right now is still primarily justices placed there by Reagan. Meaning Conservative Justices.
So Ashcroft isn't pissing off the Justice System. If he keeps at it, the High Court is likely to be more sympathetic to his case than many of the lower courts.
Well, Ashcroft has managed to step on the toes of many circuit court judges already. He might not have angered and Supreme Court justices, but everything has it's effect.
