I voted like... two weeks ago. If you can vote today, please do. Think the long term picture, too. 2 - 4 Supreme Court Justices. Those are life time terms, my friend.

Apparently most of my luck is going elsehwere today, so I hope it is being put to good use by someone. I've almost mangled myself by stupidity a few times today. I have no idea what the heck is going on with all of this.

Anyway... I have things I need to get done. I'll drop by later with things.

Thank god someone other than law students are freaking out over the Sup.Ct. issue.

There are too many things that are sitting with one judge on one side right now for me not to care.

Heh. No kiddin' sistah. I wonder if people realize if the Religous Right has control of the Executive for another term we can kiss goodbye to Miranda and Rowe v. Wade.

Yeah. That's one of them. Probably the largest in my mind but not the only one.

Supreme Court Appointments are not necessarily for life. The term that is used is "In Good Behavior." That means that if a Justice, not just the Supreme Court, any Federal Judge, is corrupt or a criminal, they can be impeached. Granted, Judges are not impeached often but it is Consitutionally possible.

Striking down Miranda or Rowe v. Wade wouldn't constitutde a breach of good behavior. Nor would allowing prayer in school, etc. All of that would be covered under Constitutional interpretation.

That is correct. The Justices are the final arbitors of interpreting the Constitution. The "In Good Behavior" clause refers to opinions made because a Justice was bribed or if the Justice has broken grievous laws. Rowe v. Wade is a legal interpretation, as is Miranda.

I honestly believe that nobody on the Court wants to revisit Rowe v. Wade. If you noticed they did not rule on the prayer in schools debate, they tossed it out on a technicality.

I'm less optimistic than you. I think they're waiting until they have a majority and don't have to rely on O'Connor. We know that Scalia isn't afraid of trying to axe major cases (he tried to kill Katz with Houghton but it didn't take). I think Rhenquist would be afraid of his legacy being that he killed the only 2 cases laymen know about, but I doubt Scalia has that same fear. And for as much as I disgree with Scalia, I admire the strength of his convictions.

I do not think that there will be as many vacancies on the Court as is being speculated. I do think that Rhenquist might step down, with the health problems it makes sense. If Bush is re-elected, I think he will retire. That would mean a conservative on the court with the same narrow majority. Scalia speaks his mind and does not seem to care who knows it.

Perhaps my position in the center is the issue. I can find opinions from all of the Justices I agree with.

Cool - heh, they're eyeglasses. Left lense has a decent size chip in it and pops out of the frame really easily.
